• El titular del alquiler o arrendatario ha de ser mayor de 18 años y será el responsable del equipo alquilado. También deberá poseer Documento Nacional de Identidad o Pasaporte del que haremos una copia.

• Los menores, a partir de 16 años, podrán realizar la actividad con autorización por escrito o presencia de un adulto, para la inscripción en el lugar de la actividad.

• Los menores de 16 años, sólo podrán realizar la actividad, con un adulto en el agua junto a ellos.

• El pago del alquiler del material se hará por adelantado por el total del servicio y en el momento de la recogida del mismo.

• El arrendatario declara saber nadar y estar en perfecto estado de salud y con las condiciones necesarias para la práctica de la actividad. Tendrá que tener en cuenta nuestras indicaciones y normas de seguridad sobre la práctica en el lugar, tales como límites en la navegación, prohibiciones de uso, límite de plazas, etc.

• El uso del chaleco salvavidas es obligatorio para el servicio de alquiler de kayak mientras se estén en el agua.

• El incumplimiento del horario implicará un recargo que dependerá de la cantidad de tiempo extra. La entrega antes de la finalización del contrato no ocasionará ningún tipo de abono o reembolso.

• El arrendatario es responsable de estar asegurado con una adecuada cobertura contra riesgos que se puedan presentar durante el periodo de alquiler.

• El arrendador no se hace responsable de reclamaciones por accidentes, heridas, golpes o daños ocasionados a sí mismo o a terceros (personas o bienes) durante el periodo de alquiler.

• El arrendatario se compromete a cuidar el material, evitando golpear contra objetos o personas, juegos que puedan provocar la rotura o fractura del material. Se hará responsable a ante daños ocasionados, pérdidas del material por robo o mal uso del mismo.

• El alquiler es personal y solo se autoriza el uso de las personas que acompañen en el momento del alquiler. Salvo autorización expresa de nuestro personal y con las indicaciones que les de, no se puede compartir del uso del material.

• El arrendador podrá rescindir unilateralmente el contrato antes de la fecha de su conclusión en caso de incumplimiento grave por parte del arrendatario en el uso y cuidado del material. En este caso el arrendador podrá tomar posesión inmediata del material en el lugar en que se encuentre, sin que tenga derecho el arrendatario a ningún tipo de reclamación o indemnización.

• Respetar y cuidar el medio que nos rodea, así como a la flora y fauna marina que se puedan encontrar.

• Respetar a los bañistas dejando una distancia de 5 m. o más con ellos.

• El Cliente se compromete expresamente a pagar al Arrendador el importe de toda clase de multas, casos judiciales y extrajudiciales derivados del uso indebido, infracciones y toda clase de normas que sean dirigidas contra el objeto alquilado.

• El Arrendador se reserva el derecho de suspensión del alquiler de kayak por causas justificadas o por incumplimiento de las normas, así como exigir al cliente, si ello hubiese lugar, las correspondientes indemnizaciones de perjuicio que fueran imputables al mismo.

• El Arrendatario, conviene en proteger los intereses del Arrendador, en caso de accidente, no abandonando el material alquilado, sin tomar las medidas para protegerlo y salvaguardarlo.

• El Arrendador no se hace responsable por pérdidas o daños en objetos dejados, guardados o transportados en el kayak.

• El Arrendatario declara haber leído y aceptado las anteriores condiciones.

• En caso de divergencia o pleito entre las partes de este contrato, éstas se someterán a la jurisdicción de los Tribunales de Las Palmas de Gran Canaria.

 

 

 

The renter or hirer must be over 18 years of age and will be responsible for the rented equipment. They must also be in possession of a National Identity Card or Passport, a copy of which we will make a copy.

The hirer declares to know how to swim and to be in perfect health and with the necessary conditions for the practice of the activity. He/she will have to take into account our indications and safety rules about the practice in the place, such as limits in navigation, prohibitions of use, limit of places, etc.

The use of life jackets is compulsory for the kayak rental service while on the water.

Failure to comply with the timetable will result in a surcharge depending on the amount of extra time. Delivery before the end of the contract will not result in any credit or refund.

- The hirer is responsible for being adequately insured against risks that may occur during the rental period.

- The hirer is not liable for claims for accidents, injuries, blows or damage caused to himself or to third parties (persons or property) during the rental period.

- The hirer undertakes to take care of the equipment and to avoid knocking against objects or persons or playing games that could lead to breakage or fracture of the equipment. He/she will be held responsible for any damage caused, loss of equipment due to theft or misuse of the same.

- The rental is personal and only the use of persons accompanying them at the time of rental is authorised. Unless expressly authorised by our staff and in accordance with the instructions given to them, the use of the equipment may not be shared.

- The lessor may unilaterally terminate the contract before the date of its conclusion in the event of serious non-compliance by the lessee in the use and care of the equipment. In this case, the lessor may take immediate possession of the equipment at the place where it is located, without the lessee being entitled to any claim or compensation of any kind.

- Respect and care for the environment that surrounds us, as well as the marine flora and fauna that may be found.

- Respect bathers by keeping a distance of 5 m or more from them.

- The Client expressly undertakes to pay the Lessor the amount of all kinds of fines, judicial and extrajudicial cases arising from improper use, infringements and all kinds of rules that are directed against the rented object.

- The Lessor reserves the right to suspend the kayak rental for justified reasons or for non-compliance with the rules, as well as to demand from the client, if applicable, the corresponding compensation for damages that are attributable to the same.

- The Hirer agrees to protect the interests of the Lessor in the event of an accident by not abandoning the rented equipment without taking measures to protect and safeguard it.

- The Lessor cannot be held responsible for loss or damage to objects left, stored or transported in the kayak.

- The Lessee declares to have read and accepted the above conditions.

- In case of divergence or lawsuit between the parties to this contract, they will submit to the jurisdiction of the Courts of Las Palmas de Gran Canaria.
